Family legal matters are among the most contentious and challenging to resolve. This is especially true if the issues end up in court. The Family Law Mediation Process

Mediation is an increasingly popular form of alternative dispute resolution that allows participants to resolve their differences in a cooperative rather than combative setting. The process is facilitated by a neutral, third-party mediator who helps keep the discussion focused on the underlying issues and guides the parties toward a workable settlement. The process is non-binding, and although it is facilitated by the mediator, the participants ultimately control the outcome. The mediator has no authority to impose a settlement on the parties involved, everyone must be in agreement for a settlement to be reached.

For family law mediation to be successful, both parties must enter the process in good faith and with reasonable expectations. They must understand that they will not receive everything they want and be willing to compromise on some issues for the overall benefit of reaching an amicable agreement.

There are several reasons families may opt for mediation rather than traditional litigation including:

  • Lower Costs: Mediation can save participants a significant amount of money on court costs and legal fees.
  • Expedited Process: If the process results in a successful resolution, it can usually be completed much faster than going to court.
  • Confidentiality: Everything that is said during mediation is kept private and confidential. This allows parties to openly express their viewpoints without worrying that their words might be used against them.
  • Flexibility: Courts tend to impose "cookie cutter" resolutions. With mediation, participants have greater control over the process, allowing them to craft more creative settlements to suit their specific needs.
  • Less Stressful: Mediation is a cooperative process that creates an environment where important family relationships can be preserved.

Mediation can be a viable option for many family legal disputes, but it is not for everyone. There are cases in which the process should not be used, such as when there is a history of abuse, mental illness, or alcohol/drug abuse. Attorney Angel Traub thoroughly understands the mediation process and when to use mediation for best results.
